1. Agreement to These Terms

These Terms of Service (the "Terms") govern your access to and use of BeanFM, operated by Huewis LLC ("BeanFM," "we," "us," or "our"). By accessing or using BeanFM, you agree to these Terms. If you do not agree, do not use BeanFM.

2. The Service

BeanFM provides tools for creating and playing soundscapes intended to support pet desensitization sessions. The Service is not veterinary, behavioral-health, or emergency advice, and it does not replace a veterinarian, qualified trainer, or animal behavior professional. You are responsible for monitoring your pet and selecting an appropriate volume, duration, and setting for each session.

3. Eligibility and Accounts

You must provide accurate account information and keep your login credentials secure. You are responsible for activity that occurs through your account. Notify us promptly at [email protected] if you believe that your account has been accessed without authorization.

We may require email verification before providing access to certain features. You may not share your account or use another person's account without permission.

4. Acceptable Use

You may use BeanFM only in compliance with these Terms and applicable law. You may not:

  • interfere with, disrupt, probe, or bypass the security or operation of the Service;
  • use automated systems to generate excessive requests or evade technical limits;
  • copy, modify, reverse engineer, decompile, or create derivative works from the Service except where applicable law prohibits a restriction;
  • access content or accounts without authorization;
  • use the Service to infringe the rights of another person or entity; or
  • use the Service in a manner that is unlawful, harmful, fraudulent, or abusive.

We may limit, suspend, or terminate access when we reasonably believe that use violates these Terms, threatens the Service or other users, or creates a security, legal, or operational risk. Our Fair Use Policy provides additional information about excessive or abusive use.

5. Pet Profiles and Your Content

You retain ownership of the information and images you submit for your pet profiles. You give us a non-exclusive, worldwide, royalty-free license to host, process, reproduce, and display that content only as necessary to operate, secure, and improve BeanFM.

You represent that you have the necessary rights to submit your content and that it does not violate law or another person's rights. Do not upload content that is unlawful, infringing, abusive, or harmful.

6. Administrator-Provided Content

Administrators who upload audio, images, or related metadata represent that they have the rights and permissions needed to do so. Administrators are responsible for providing accurate licensing, attribution, and provenance information. We may remove or disable content when we believe it may violate rights, these Terms, or applicable law.

7. Intellectual Property

The Service, including its software, design, branding, and our content, is owned by Huewis LLC or its licensors and is protected by applicable intellectual-property laws. Except for the limited right to use the Service under these Terms, no rights are granted to you.

8. Feedback

If you send us feedback, suggestions, or ideas about BeanFM, you give us the right to use them without restriction or compensation to you.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR THAT IT WILL MEET YOUR REQUIREMENTS.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, Huewis LLC AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, LICENSORS, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS.

11. Indemnification

To the extent permitted by law, you will defend, indemnify, and hold harmless Huewis LLC and its affiliates, officers, employees, agents, licensors, and suppliers from claims, damages, losses, and expenses, including reasonable attorneys' fees, arising from your content, your use of the Service, or your violation of these Terms or applicable law.

12. Governing Law and Disputes

These Terms are governed by the laws of Wyoming, United States, without regard to conflict-of-law rules. Any dispute arising out of or related to these Terms or the Service will be brought exclusively in the state or federal courts located in Wyoming, and you consent to their jurisdiction and venue.

13. Changes to the Service or These Terms

We may modify or discontinue all or part of the Service. We may also update these Terms from time to time. When we do, we will post the revised Terms and update the "Last updated" date above. Your continued use of BeanFM after the effective date of revised Terms means that you accept them.
